The Benefit of Making a Lasting Power of Attorney

You do not know what may happen to you in the future and should something happen that means you are unable to conduct your own affairs, in respect of financial and medical matters, it can be a long and expensive task of obtaining the courts permission to make decisions on your behalf.

The Benefits of making a Lasting Power of Attorney are:

• You can make sure that you, your assets and properly are looked after if you start to struggle or become unable to yourself.

• You can choose and appoint the people who you trust to make those decisions.

• You can plan and state in advance the decisions you want others to make on your behalf if you ever lose capacity to make them yourself.

• A safe way of making sure the right decisions are made on your behalf because the Lasting Power of Attorney has to be registered withthe Office of Public Guardian before it can be used.

It is important that you take expert advice to ensure that any appropriate restrictions are included and that your Lasting Power of Attorney is properly registered with the Office of the Public Guardian (OPG). In addition if you were to become incapable of managing your affairs without having a LPA in place your loved ones would have to undertake a lengthy and sometimes costly application to the Court of Protection to be appointed your Deputy before they were able to help with managing your affairs.
