Living Together, a match made in hell.

Back to News

When two people chose to live together but are not married it is also known as cohabitation. Often two people who live together for a long period of time believe that they are common law husband and wife and have the same rights as married couples. This is not true.

“Often two people who live together for a long period of time believe that they are common law husband and wife and have the same rights as married couples. This is not true.”

The law is very different when dealing with people who live together compared with those who are married and can be very complicated. Married couples will be able to make a claim against the assets held in the other person’s name even if they have not contributed towards them. Those who live together cannot and would have to prove that they have contributed to that asset.

“This can save a lot of money further down the line if things turn sour”

If you a buying a property together and making an unequal contribution then you should enter into a Deed of Trust which details who owns what and how this is divided should the relationship breakdown. This can save a lot of money further down the line if things turn sour.
